3. Website Terms and Client Service Agreements
These Terms govern the website and initial care-application process.
They do not constitute a complete care-services contract and do not, by themselves, create a caregiver-client relationship.
If we agree to provide care, the client or authorised representative may be required to enter into a separate written Client Service Agreement. That agreement may address:
- The agreed services;
- Client assessment;
- Care schedule;
- Service location;
- Fees and payment terms;
- Cancellations and rescheduling;
- Access to the client’s home;
- Caregiver duties and limitations;
- Family communication;
- Emergency procedures;
- Suspension or termination of services; and
- Other conditions specific to the client.
If these Terms conflict with a signed Client Service Agreement concerning the provision of care, the Client Service Agreement will take priority for that service relationship.
4. Eligibility to Use the Website
You must be at least 18 years old and legally capable of entering into an agreement to submit a care application.
You may submit an application:
- For yourself;
- For a family member;
- As an authorised representative;
- As a legal guardian or person holding appropriate authority; or
- With the knowledge and permission of the person needing support, where reasonably possible.
We may request evidence of your identity, relationship or authority before discussing sensitive information or beginning services.
5. Providing Information About Another Person
If you provide personal, health or care-related information about another person, you confirm that:
- You are authorised to provide that information;
- The information is accurate to the best of your knowledge;
- You have obtained any consent reasonably or legally required;
- You have informed the person about the application where reasonably possible;
- You will direct the person to our Privacy Policy where appropriate; and
- You are not submitting the information for an improper, deceptive or harmful purpose.
Providing information about a person does not automatically give you authority to make healthcare, financial or legal decisions on that person’s behalf.
We may contact the person needing support or request additional documentation before accepting instructions from a representative.
6. Care Applications and Enquiries
Submitting an application or enquiry:
- Is a request for us to review your family’s needs;
- Does not commit you to purchasing a service;
- Does not guarantee that we will accept the application;
- Does not guarantee that a caregiver is available;
- Does not guarantee an immediate response or start date;
- Does not reserve a particular caregiver or schedule;
- Does not constitute an assessment, diagnosis or professional medical recommendation; and
- Does not create a client-caregiver relationship.
We may accept, decline, pause or refer an application based on factors including:
- The individual’s care needs;
- Safety considerations;
- Service location;
- Caregiver availability;
- Required skills or supervision;
- The home environment;
- Whether the requested activities fall within our non-medical scope;
- Whether appropriate consent or authority is available; and
- Whether we can reasonably and safely provide the requested support.
We are not required to disclose confidential staffing information or every internal reason considered when reviewing an application.
7. Accuracy of Information
You agree to provide information that is complete and accurate to the best of your knowledge.
You should promptly tell us if relevant information changes, including changes relating to:
- The client’s health or mobility;
- Diagnoses or medications;
- Behaviour or cognitive condition;
- Home access;
- Safety risks;
- Emergency contacts;
- The support requested; or
- Your authority to act for the client.
JJ’s Blessed Hands is not responsible for delays, unsuitable arrangements or other consequences caused by materially inaccurate, incomplete or withheld information, except to the extent responsibility cannot lawfully be excluded.
8. Non-Medical Nature of Our Services
JJ’s Blessed Hands provides non-medical in-home support.
Unless separately stated in writing and delivered by an appropriately licensed professional, our services do not include:
- Medical diagnosis;
- Nursing assessment;
- Clinical treatment;
- Prescribing medication;
- Changing medication or dosage;
- Administering medication;
- Injections;
- Wound care;
- Medical procedures;
- Physiotherapy;
- Mental-health treatment;
- Emergency medical response;
- Continuous medical monitoring; or
- Services that legally require a licensed healthcare professional.
Medication support is generally limited to reminders and reasonable observation. Caregivers do not decide whether medication should be taken, stopped or changed.
Information on our website is general information only. It is not medical advice and should not replace advice from a physician, nurse, pharmacist or other qualified professional.
9. Emergencies
The website, application form, email address, WhatsApp service and social-media accounts are not emergency services and may not be monitored continuously.
Do not use them to report:
- A medical emergency;
- Immediate danger;
- Suspected serious abuse;
- A missing person;
- A fire;
- A crime in progress; or
- Another urgent threat to life or safety.
In an emergency, contact the appropriate emergency service, medical provider or responsible local authority immediately.
Submission of an online application does not create a duty for JJ’s Blessed Hands to monitor or respond to an emergency.
10. Assessments and Service Suitability
Before services begin, we may request:
- An initial telephone or video consultation;
- A home or care-needs assessment;
- A discussion with the client;
- Relevant information from family members;
- Emergency contact details;
- Information about health, mobility, behaviour or safety;
- Confirmation of home access arrangements;
- Consent and authorisation documents; and
- A signed Client Service Agreement.
An assessment is intended to help us understand whether we can provide the requested non-medical support safely. It is not a medical diagnosis or guarantee that a particular service outcome will be achieved.
We may recommend that the family consult a licensed healthcare professional or another specialist where needs appear to fall outside our scope.
11. Service Availability
Service availability may depend on:
- The client’s location in Grenada;
- Caregiver availability;
- The requested days and hours;
- The level of assistance required;
- Travel and transportation conditions;
- Weather or natural disasters;
- Public-health or safety concerns;
- Staff illness;
- Home-access arrangements; and
- Other operational circumstances.
Website content, advertisements or previous discussions do not guarantee that a particular service, caregiver, schedule or start date is available.
12. No Guarantee of Outcomes
We aim to provide dependable and respectful support. However, the outcome of care may be affected by circumstances outside our control, including:
- Changes in the client’s health;
- The client’s choices or refusal of assistance;
- Inaccurate or incomplete information;
- Actions of family members or third parties;
- Medical conditions;
- Emergencies;
- Home conditions; and
- Events outside our reasonable control.
We do not guarantee that our services will prevent falls, illness, hospitalisation, deterioration, injury, loneliness or other adverse events.
Nothing in these Terms removes any responsibility we have under applicable law or a signed Client Service Agreement.
13. Communications
By submitting an application, you authorise us to contact you about that application through the contact methods you provide, which may include:
- Telephone;
- WhatsApp;
- Email; or
- Text message.
Application-related communications are not marketing communications.
Marketing consent, where requested, will be separate. You may withdraw marketing consent without affecting necessary communications about an application or active service.
Electronic communications may be delayed, intercepted, misdirected or accessed on a shared device. You are responsible for choosing a reasonably secure communication method and telling us if a particular channel should not be used.
14. Fees and Payments
Submitting a standard online application does not require payment unless we clearly state otherwise before submission.
Fees for care assessments or services will be communicated separately before the relevant paid service begins.
Unless stated in a signed agreement:
- Website descriptions are not binding quotations;
- Fees may vary based on the support required, duration, location and schedule;
- A price discussed during an initial enquiry may be subject to assessment; and
- No payment creates an entitlement to services outside the agreed scope.
Payment terms, deposits, refunds, cancellations and overdue amounts will be governed by the applicable Client Service Agreement, invoice or written payment terms.
15. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
Because care applications may contain sensitive information, you should provide only information reasonably necessary for us to understand the situation.
Do not submit:
- Passwords;
- Online banking credentials;
- Full payment-card details;
- Unnecessary identification documents;
- Unrelated medical records; or
- Information you are not authorised to disclose.
16. Acceptable Use
You agree not to:
- Use the website for unlawful, fraudulent or harmful purposes;
- Submit false or misleading information;
- Impersonate another person;
- Misrepresent your authority to act for someone;
- Submit information obtained without appropriate permission;
- Attempt to access another person’s application or records;
- Interfere with the website’s security or operation;
- Introduce viruses, malicious code or harmful technology;
- Use automated tools to scrape or copy website content without permission;
- Attempt to overload or disrupt the website;
- Use our contact channels to harass, threaten or abuse anyone;
- Submit spam or unauthorised advertising;
- Infringe intellectual-property or privacy rights; or
- Use website content to provide misleading medical or care advice.
We may restrict or block access where we reasonably believe these Terms have been violated or the website’s safety is threatened.
17. Intellectual Property
The website and its contents—including text, branding, graphics, photographs, forms, page designs and other original materials—are owned by or licensed to JJ’s Blessed Hands and are protected by applicable intellectual-property laws.
We grant you a limited, personal, non-exclusive and revocable right to access and use the website for lawful personal purposes.
You may not, without prior written permission:
- Reproduce substantial portions of the website;
- Republish or commercially exploit the content;
- Modify or create derivative commercial materials;
- Remove copyright, trademark or ownership notices;
- Use our branding in a way that suggests endorsement; or
- Copy our application forms or service descriptions for a competing service.
You may save or print a reasonable copy for your personal records.
18. Information You Submit
You retain ownership of information and materials you submit.
You grant JJ’s Blessed Hands permission to use submitted information to:
- Respond to your enquiry;
- Review the application;
- Assess service suitability;
- Communicate with authorised persons;
- Provide requested services;
- Maintain appropriate records; and
- Meet legal, safety and administrative obligations.
This permission does not allow us to use sensitive care information for unrelated promotional purposes.
Feedback or testimonials will not be published using identifiable information without appropriate permission.
19. Third-Party Services and Links
The website may link to or use third-party services, including:
- WhatsApp;
- Email providers;
- Social-media platforms;
- Online forms;
- Website-hosting providers;
- Analytics services;
- Payment providers; and
- Maps or scheduling services.
We do not control third-party services and cannot guarantee their availability, security or content.
Your use of a third-party service may be governed by that provider’s terms and privacy policy.
A link does not necessarily mean that JJ’s Blessed Hands endorses every product, service or statement appearing on the third-party website.
20. Website Availability and Changes
We aim to keep the website accurate and available, but we do not guarantee uninterrupted or error-free access.
We may:
- Update website content;
- Correct errors;
- Change forms or functionality;
- Add or remove services;
- Suspend access for maintenance or security;
- Restrict access to protect users; or
- Discontinue all or part of the website.
We are not responsible for temporary unavailability caused by maintenance, technical failures, internet problems, cyberattacks or events beyond our reasonable control.
21. Website Information and Disclaimer
We make reasonable efforts to keep website information accurate. However:
- Website content may contain errors or become outdated;
- General care information may not apply to every person;
- Service descriptions may be summarised;
- Images may be illustrative;
- Availability may change; and
- Website information does not replace a personalised assessment or signed agreement.
To the extent permitted by law, the website is provided on an “as available” basis.
Nothing in these Terms excludes warranties or protections that cannot lawfully be excluded.
22. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded for:
- Fraud or fraudulent misrepresentation;
- Deliberate misconduct;
- Gross negligence where applicable;
- Death or personal injury caused by negligence where such liability cannot be excluded; or
- Violation of mandatory consumer rights.
Subject to those exceptions and to the extent permitted by applicable law, JJ’s Blessed Hands will not be responsible for:
- Indirect or consequential loss arising solely from use of the website;
- Loss caused by reliance on general website information instead of professional advice;
- Loss caused by inaccurate or unauthorised information submitted by a user;
- Third-party websites or communication platforms;
- Internet or telecommunications failures;
- Unauthorised access resulting from a user’s insecure device or account;
- Missed messages caused by incorrect contact information; or
- Events outside our reasonable control.
Any liability relating to actual care services will be addressed by applicable law and the signed Client Service Agreement.
23. Your Responsibility for Misuse
To the extent permitted by law, you are responsible for reasonable losses suffered by JJ’s Blessed Hands as a direct result of your:
- Deliberate misuse of the website;
- Fraudulent application;
- Material misrepresentation;
- Unlawful disclosure of another person’s information;
- Infringement of intellectual-property rights; or
- Intentional violation of these Terms.
This section does not require a consumer to compensate us for matters caused by our own negligence, unlawful conduct or breach of duty.
24. International Users and Consumer Rights
Our organisation and care services are based in Grenada, although website visitors and family representatives may live elsewhere.
If you access the website from the United Kingdom, United States, Canada or another jurisdiction, you are responsible for complying with local laws that apply to your use.
Nothing in these Terms is intended to remove mandatory consumer rights that apply in your country, state, province or territory.
Where a mandatory local law gives you protections that cannot be waived by contract, those protections will continue to apply.
25. Governing Law and Disputes
These Terms are governed by the laws of Grenada, without excluding mandatory rights that may apply to a consumer in another jurisdiction.
Before beginning formal proceedings, you and JJ’s Blessed Hands agree to make a reasonable good-faith effort to resolve the matter informally.
You may begin this process by emailing:
Please include:
- Your name;
- Your contact information;
- A description of the issue;
- Relevant dates; and
- The outcome you are requesting.
If the matter cannot be resolved informally, disputes will be subject to the courts of Grenada unless applicable consumer law gives you the right to bring a claim in another jurisdiction.
Nothing in this section prevents either party from seeking urgent legal relief where necessary to protect a person, confidential information or legal rights.
26. Events Beyond Our Reasonable Control
We will not be responsible for delay or failure caused by events outside our reasonable control, including:
- Hurricanes, storms, floods, earthquakes or other natural disasters;
- Epidemics or public-health emergencies;
- Government restrictions;
- Civil unrest;
- Road closures or transportation disruption;
- Utility or telecommunications failures;
- Cyberattacks;
- Labour disruption;
- Fire;
- Serious staff illness; or
- Other comparable events.
If such an event affects scheduled care, the applicable Client Service Agreement and emergency communication procedures will govern the response.
27. Changes to These Terms
We may update these Terms to reflect changes in:
- Our services;
- Website functionality;
- Business practices;
- Technology;
- Legal requirements; or
- Safety and security needs.
The revised version will display a new “Last updated” date.
Material changes will apply prospectively unless applicable law requires otherwise. Continued use of the website after updated Terms take effect indicates acceptance of the revised Terms.
Changes to an existing signed Client Service Agreement will be handled according to that agreement and will not occur merely because these website Terms were updated.
28. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue in effect.
29. No Waiver
If we do not immediately enforce a provision of these Terms, that does not mean we have waived the right to enforce it later.
A waiver will be effective only if made in writing by an authorised representative of JJ’s Blessed Hands.
30. Assignment
You may not transfer your rights or obligations under these Terms to another person without our written consent.
We may transfer our rights and obligations as part of a lawful restructuring, merger, business transfer or similar transaction, subject to applicable consumer and privacy laws.
31. Entire Agreement
These Terms, together with our Privacy Policy and any notices displayed on the website, form the agreement governing use of the website and care-application process.
Actual care services will also be governed by the applicable Client Service Agreement and written care plan.
